This document outlines Maisonlink’s communication standards, protocols, and the methods employed to engage with users. It also affirms the company’s commitment to full compliance with the Telephone Consumer Protection Act (TCPA).

Users are encouraged to carefully read and understand the terms and conditions outlined in this Agreement, as it contains important information regarding communication practices. Of particular note, this Agreement includes a mandatory arbitration clause, requiring that any disputes be resolved through individual arbitration rather than jury trials or class action proceedings.

At Maisonlink, we take user privacy seriously. This Communication Policy details how personal information is collected, utilized, and safeguarded across our website and affiliated digital platforms. Users who do not agree with these practices are advised not to use our services.

Maisonlink may engage with users through various communication channels, including but not limited to SMS, social media platforms (such as Facebook, Instagram, Twitter, and Pinterest), messaging applications (including WhatsApp, Viber, and WeChat), customer relationship management (CRM) systems, email communications, and mobile applications. These communications may be conducted on behalf of Maisonlink, its affiliates, and associated advertisers.

By accessing and using Maisonlink’s website, users expressly consent to receiving marketing communications, including promotional messages related to products or services. These communications may be delivered via methods such as automated dialing systems, prerecorded voice messages, and text messages, using the contact information provided by the user. While some promotions may extend beyond the user’s expressed interests, they are curated to offer potentially relevant opportunities. Importantly, consenting to this Communication Policy is not a condition for purchasing any goods or services from Maisonlink.

Maisonlink reserves the right to modify this Communication Policy at any time without prior notice. Continued use of the Site constitutes acceptance of any such modifications. Users are encouraged to review this policy periodically for updates.

All communications provided by Maisonlink are offered on an “as is” basis and may not be accessible to all users or through all service providers at all times. The company reserves the right to modify or discontinue any communication services or programs at its sole discretion, without notice or liability.

Maisonlink, along with its affiliates, officers, directors, employees, and consultants, shall not be held liable for any damages, losses, or injuries-whether direct or indirect-arising from communication disruptions or technical failures. Furthermore, the company reserves the right to suspend or terminate the delivery of any communication at any time. Wireless carriers and service providers are not responsible for delayed, failed, or undelivered messages.

Communication services offered by Maisonlink may be subject to limitations based on user access or the capabilities of service providers. The company retains the right to alter or discontinue communication programs without prior notice or obligation.

Maisonlink’s consent requirements vary depending on the type and purpose of communication with clients. This includes categories such as Conversational, Informational, and Promotional messaging. For example, Conversational SMS/text messaging-where the company provides timely responses to user initiated inquiries with relevant information-is considered to imply consent. Therefore, explicit verbal or written permission is not required in such cases.

Information Dissemination via SMS and Voice Calls

Maisonlink delivers Informational SMS/Text and Voice Messages exclusively to customers who have voluntarily provided their phone number and explicitly consented to future communications. To receive such informational messages, customers must provide clear and affirmative consent. This consent may be obtained through various authorized channels, including-but not limited to-text message opt-in, completion of an online or physical form, interaction through the Maisonlink website, verbal agreement, or written authorization.

Promotional Text Messaging

Promotional text messaging refers to the distribution of SMS messages intended to market or promote Maisonlink’s products and services.

You may opt out of the SMS service at any time by texting “STOP” to the designated short code. Upon receipt of your “STOP” request, we will promptly confirm your unsubscription via SMS. After this confirmation, you will no longer receive promotional text messages from Maisonlink. If you wish to re -subscribe, simply complete the original sign-up process, and we will resume sending messages.

If you encounter any issues with the messaging program, reply with the keyword “HELP” for assistance, or contact us directly at support@mymaisonlink.com or call +1 786 735 2806.

Please note that wireless carriers are not responsible for delayed or undelivered messages. Standard message and data rates may apply for both incoming and outgoing messages. For specific questions regarding your text or data plan, please contact your wireless service provider.

Mobile Message Call-Outs

At Maisonlink, we utilize Call-to-Action (CTA) elements within our SMS text messages to prompt recipients to engage in specific actions, such as clicking a button or following a link. These CTAs are designed to deliver valuable information about our services, updates, and promotional offers directly to our clients.

Maisonlink is committed to respecting the communication preferences of its clients. Recipients may opt out of receiving these messages at any time by replying with a keyword such as “STOP” or by clearly expressing their desire to discontinue such communications.

Dispute Resolution

This section outlines the procedures for resolving disputes between you and Maisonlink. In the event of a dispute arising in connection with your agreement with Maisonlink-unless it qualifies for resolution in small claims court-it shall be resolved exclusively through final and binding arbitration before a neutral arbitrator.

The arbitration will be conducted on an individual basis; class arbitrations and collective actions are strictly prohibited. The arbitrator shall follow the Consumer Arbitration Rules of the American Arbitration Association, as modified by this agreement. The arbitrator’s decision will be final and binding and may include injunctive relief or specific performance, but only to the extent necessary to resolve the individual claim.

If any portion of this Dispute Resolution provision is determined to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect. However, if the waiver of class or representative actions is found to be unenforceable, the entirety of this Dispute Resolution provision will be rendered null and void. This severability clause does not affect the validity or enforceability of any other part of the overall agreement.

Please note, this agreement does not restrict you from reporting concerns to federal, state, or local government agencies. These agencies may, if the law permits, seek remedies on your behalf against Maisonlink.
